IPR Practice

Practice Group

As a full-service IP law firm, we advise and enable our clients to effectively protect their intellectual property assets and interests . We deal with prosecution and contentious IP matters including patents, trademarks, industrial designs, copyrights etc.

CLG’s IPR Practice relies on our team of skilled lawyers, IP attorneys/agents and technical specialists, who have significant exposure to international best practices and a global business environment.

IP Practice Professionals

Our IP lawyers and  professionals are experienced in  a diverse array of technical disciplines, such as chemistry, pharmaceuticals, cosmetics, drugs, biotechnology, biochemistry, research tools, vaccines, medical devices, agrochemicals, food science, electronics, software technology, mechanics, telecommunications, etc.

All our patent lawyers, patent agents and technical specialists have science or engineering (STEM) educational backgrounds – an advantage that has distinguished us – for over two decades – from many other competing IP law firms. A huge advantage in, say, for instance in hitherto ambiguous and difficult cases involving interpretation of the provisions of the Patents Act, 1970, the team has been successful in obtaining patents for derivatives of known compounds, compositions / formulations, cosmetics, biosensors, genetic probes, vaccines, phyto-chemicals, energy drinks etc. As a matter of fact we have been successful in reverting at the review stage the Controller’s decision refusing a patent application on the ground of patentability

Courts and Judicial Fora

Corporate Law Group’s IP lawyers regularly appear before the Indian Patent Office, as well as before the various Courts in patent matters. Aside from regular patent prosecution on behalf of our clients, we have successfully rendered opinions regarding patentability, freedom to operate (FTO), and validity to leading companies in the areas of chemistry, pharmaceuticals, life sciences, cosmetics, soaps, food, engineering etc.

IPR Services

Further, over the years we have been involved in several transactions in respect of technology transfer licensing agreements, due diligence on target companies in M&As where IP was a central focus and on royalty and other transactional issues. The fact that this group can draw on the expertise and experience of our other lawyers practicing in areas that impact the food, biotech and pharmaceutical industry (e.g., regulatory, government policy, competition and commercial) helps CLG provide our clients with a uniquely India focused business solution.

IP Audits & Due Diligence

Intellectual property assets, primarily patents, trademarks, copyrights and trade secrets signify valuable corporate assets. An IP Audit is defined as a systematic review of the IP owned, used or acquired by a business. It helps in ensuring that these assets are effectively protected, identifying opportunities for leveraging IP value and provide a way to effectively manage intellectual property assets continuously. We assist companies in conducting intellectual property due diligence investigations attendant to mergers/acquisitions (M&A) which consist of evaluating and managing risk, remedying problems and moving towards implementing best practices. It enables a corporation to formulate an IP strategy.

Drafting IPR Legislation

CLG is one of the very few IP law firms in India with in-depth expertise and wide experience in successfully guiding clients for protection of plant varieties and farmers’ and plant breeders’ rights. The firm was invited by the Government of India to draft sub-legislation for the Protection of the Plant Varieties and Farmers’ Rights Bill, 2000.
